Terms of Use

These Terms of Use ("Terms") are a legally binding agreement between you and Pi Cubed, LLC ("Pi Cubed," "we," "us," or "our") governing your access to and use of the WordSync mobile application and related services, including the website at playwordsync.com (collectively, the "Service").

By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Our Privacy Policy explains how we collect and use information. It is incorporated by reference into these Terms.

1. The Service

WordSync is a multiplayer party word game. Features may include (and may change over time):

We may update, suspend, or discontinue any part of the Service at any time.

2. Eligibility and Age

You must be able to form a binding contract with Pi Cubed to use the Service.

The Service is not directed to children under 13. If you are under 13, you may not use the Service. If you are 13 or older but under the age of majority where you live, you may use the Service only with a parent or guardian's consent and supervision, and they agree to these Terms on your behalf.

Mature / adult decks: Some decks contain mature, suggestive, or adult-oriented prompts. You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to access or enable adult/mature decks. By enabling such decks, you represent that you meet that age requirement. Do not enable adult decks when minors are present or sharing the device.

We may change age gates, ratings, or content availability to comply with platform rules (including Apple App Store requirements) or applicable law.

3. Accounts and Display Names

You may need a display name or account credentials to use some features. You agree to provide accurate information and to keep credentials secure. You are responsible for activity under your account or display name.

We may reclaim, suspend, or remove names that are offensive, impersonating, or otherwise violate these Terms.

4. User Content and Gameplay Inputs

"User Content" means words, prompts, messages, feedback, or other materials you submit through the Service (including answers typed in multiplayer rounds).

You retain ownership of your User Content. You grant Pi Cubed a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and use User Content as needed to operate, improve, moderate, and promote the Service.

You represent that your User Content does not violate law or others' rights. We may remove or refuse User Content at our discretion.

6. Automated Opponents and AI Features

Solo mode and similar features may use automated or AI-assisted opponents. Outputs are for entertainment, may be imperfect, and do not create any professional advice relationship. Do not rely on bot behavior as a guarantee of fairness in competitive contexts.

7. Decks, Content Ratings, and UGC Risk

Prompt decks are provided for entertainment. Family-friendly and mature decks may coexist in the product. You are responsible for choosing appropriate decks for your group and setting.

If we offer user-created or community decks in the future, additional rules may apply. Until then, treat official decks as our content and your typed answers as User Content under Section 4.

8. Advertising

The Service may display third-party advertisements (including Google AdMob interstitial and rewarded ads). Ad partners may collect or receive device and usage information as described in our Privacy Policy and in accordance with platform permissions (including Apple's App Tracking Transparency framework where required). We do not control third-party advertisers' sites or offers.

9. Purchases, Subscriptions, and Virtual Items

Optional purchases and subscriptions may be offered through the App Store and processed by Apple and/or our commerce providers (such as RevenueCat). Prices, taxes, and billing terms are shown at purchase.

10. Intellectual Property

The Service, including software, branding, decks (excluding your User Content), and design, is owned by Pi Cubed or its licensors and protected by intellectual property laws. These Terms do not transfer ownership to you. You receive a limited, revocable, non-exclusive, non-transferable license to use the Service for personal, non-commercial entertainment as permitted by these Terms and platform rules.

Apple is not a party to these Terms and is not responsible for the Service; Apple is a third-party beneficiary of your compliance with App Store rules to the extent required by Apple.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, PI CUBED DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PI CUBED AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

14. Indemnity

You agree to defend and indemnify Pi Cubed against claims arising from your User Content, your misuse of the Service, or your violation of these Terms or applicable law, to the extent permitted by law.

15. Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, if required by law or platform rules, or if we discontinue the Service. Sections that by nature should survive (including IP, disclaimers, liability limits, and indemnity) survive termination.

16. Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date will change when we do. Material changes may be communicated in the app, on the website, or by other reasonable means. Continued use after changes become effective constitutes acceptance of the updated Terms.

17. Governing Law

These Terms are governed by the laws of the State of New York, excluding conflict-of-law rules, without prejudice to mandatory consumer protections in your place of residence. Courts located in New York will have exclusive jurisdiction over disputes, except where prohibited by applicable consumer law.

18. General

If any provision is unenforceable, the rest remains in effect. These Terms are the entire agreement regarding the Service and supersede prior terms for the Service. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
